These Terms of Service ("Terms") govern your use of Agent Mask, a PII detection and de-identification software product ("Software") provided by Raccoon Data LLC ("Company," "we," "us," or "our"). By installing, requesting a trial key for, or using the Software through Snowflake Marketplace, Docker/self-hosted distribution, or another commercial arrangement, you ("Customer" or "you") agree to these Terms.
Agent Mask is a containerized application that detects and de-identifies personally identifiable information (PII) in text, structured payloads, and supported documents. The Software runs in the deployment environment you choose, such as your Snowflake account through Snowpark Container Services (SPCS) or your own self-hosted infrastructure. Agent Mask is designed so processing occurs inside that deployment environment.
Subject to your compliance with these Terms and payment of applicable fees, or during an authorized free trial, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Software during the applicable subscription, trial, or license term for your internal business purposes.

You are responsible for the environment where you run the Software, including compute resources, access controls, network exposure, storage configuration, secrets, backups, and associated costs. For Snowflake Marketplace deployments, you are responsible for your Snowflake account and costs charged by Snowflake. For self-hosted deployments, you are responsible for your container platform, GPU/runtime environment, ingress, authentication, and storage.
Fees for Snowflake Marketplace deployments are charged through the Snowflake Marketplace according to your selected subscription tier, and payment terms are governed by your agreement with Snowflake. Self-hosted trials may be provided free for a limited evaluation period. Commercial self-hosted access, if offered, is governed by the applicable order form, invoice, marketplace terms, or written agreement. We reserve the right to modify pricing for future subscription or license periods with reasonable notice.
We retain all right, title, and interest in the Software, including all intellectual property rights. These Terms do not grant you any rights to our trademarks or branding. You retain all rights to your data.
We do not have access to data you process using the Software. Any confidential information you share with us directly (such as through support requests) will be protected and used only to provide the requested services.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
We do not warrant that:
PII detection relies on pattern matching, machine learning models, and heuristics that may produce false positives or false negatives. You must validate results for your use case.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RACCOON DATA LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SOFTWARE, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
These limitations apply even if we have been advised of the possibility of such damages and even if a remedy fails of its essential purpose.
You agree to indemnify and hold harmless Raccoon Data LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Software; (b) your violation of these Terms; (c) your violation of applicable laws; or (d) your data or content.
These Terms are effective until terminated. Your subscription, trial, or license term and renewal are governed by the applicable Marketplace listing, license key, order form, invoice, or written agreement. We may terminate or suspend your access immediately if you breach these Terms. Upon termination or expiration, your license to use the Software ends. Sections 6, 7, 8, 9, 10, and 13 survive termination.
We may modify these Terms at any time by posting updated Terms on our website. Material changes may be communicated through Snowflake Marketplace, email, or another customer communication channel. Continued use of the Software after changes take effect constitutes acceptance of the modified Terms.
Governing Law: These Terms are governed by the laws of the State of New Mexico, without regard to conflict of law principles.
Disputes: Any disputes arising from these Terms shall be resolved in the state or federal courts located in New Mexico, and you consent to the jurisdiction of such courts.
Entire Agreement: These Terms constitute the entire agreement between you and Raccoon Data LLC regarding the Software and supersede all prior agreements.
Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
Waiver: Failure to enforce any right does not waive that right.
Assignment: You may not assign these Terms without our consent. We may assign these Terms freely.
